INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The purpose of the Website is, in general, to provide the public with knowledge of the activity carried out by Intecfy, which consists of offering a personalized talent recruitment service that uses a combination of first class human resources technology and the vast experience of expert consultants to guarantee the perfect match.
Within the content referred to in this section and referred to in our Web Page is included, but not limited to, programming, editing, compilation and other elements necessary for its operation, designs, logos, text and / or graphics, which are owned by Intecfy, if not, has a license or express authorization from the authors for their use. Regardless of the purpose for which they were intended, the total or partial reproduction, use, exploitation, distribution and marketing of any content of the Website requires in any case of prior written authorization by Intecfy. Any unauthorized use of the previously specified content is considered a serious breach of the intellectual or industrial property rights of the rightsholder.

Given that Intecfy cannot always control the content posted by third parties on their respective websites, we do not assume any type of responsibility with respect to such contents. PURPOSE AND ACCEPTANCE OF INTECFY SERVICES
In the event that you enter into a commercial relationship with us either as our client, candidate or external recruiter, it is necessary that you have read and accepted the terms and conditions that we set out below. If you do not agree, we will not be able to provide you with our services and therefore you should refrain from entering into this business relationship with us, as they will be primarily applicable before different or additional conditions that some of our services may have. In case of conflict, these Terms and Conditions shall prevail.
Likewise and in the relationship with our clients, we inform you that the Conditions of Agreement document that we provide you in which the different economic possibilities to which you can be subject in relation to our fees as well as the guarantees and commitments of both clients and Intecfy, is also part of the totality of these T&C and therefore the possibility chosen by each of the clients will be applicable in its entirety, without exception.
DETAILS ABOUT OUR SERVICES AND THE PROCESSING OF PERSONAL DATA BY INTECFY IN THE PERFORMANCE OF OUR BUSINESS
The services provided by Intecfy are intended to facilitate the recruitment of candidates for the positions offered by clients, with the aim of ensuring that they can fill these vacancies with the best profile that suits their needs.
Specifically, our services are based on the following points which we believe summarize in a broad and transparent way our recruitment process until we find the perfect match between our clients and the candidates:
- Our priority is to offer our clients a personalized professional headhunting service for IT Freelance professionals.
- To achieve this objective and among others, the recruitment process will be mainly based on the following milestones:
– Request for information on the job position and the profile of the prospective employee, the required know-how, the expected results, the problems to be solved, the desired competencies, the required training, the salary, the required personal experience, etc.
– Determination of the potential target market with attractive candidates, sectors or companies of origin, key positions of origin, minimum results obtained in the past, etc.
– Selection of sources. The headhunter may make use of professional networks such as LinkedIn, his/her network of contacts in a specific sector or follow different strategies to access potential candidates
– It is possible that the services may entail posting the job offer on job portals
– Evaluation of the skills and knowledge of each of the candidates who have applied for the offered job, as well as the analysis of the level of compatibility with the client thanks to the use of specialized technological tools.
– Development of materials that assist clients in making recruitment decisions and simplify the recruitment process.
– Sending newsletters and other communications intended to send our clients and candidates (if they so consent or after establishing a business relationship with them) information about our services or our activity that we believe may be of interest to them.
DETAILS OF THE PROCESSING OF PERONAL DATA CARRIED OUT IN THE COURSE OF OUR BUSINESS
While information regarding the privacy policy for personal information processed through the Website is available here, we now inform you about the processing of personal data that we at Intecfy will carry out on the data of candidates that we submit to our clients (or clients themselves) to meet their needs and create a perfect match.
Therefore, this data processing will depend on whether the person contacting us is a candidate, a recruiter or a person acting on behalf of one of our existing or potential clients.
- Clients: the processing of the data is based on the need of execution of the services provision Agreement, in accordance with the provisions of article 6.1.b) RGPD and we will process the following data:
– Data identifying the staff with whom we interact in order to understand the client’s needs.
– Professional details of such staff - Candidates: the legitimate basis for processing their data will depend on the purpose for which they are collected:
– Reception of CVs and registration on our platform. For this purpose, the legal basis for processing is their consent in order to contact them in accordance with the provisions of Article 6.1.a) GDPR, given that they authorize us to do so either by contacting us or by accepting the processing of their data in the event that we contact them by various means (e.g. via their LinkedIn profile). We will process the following data: personal identification and contact data as well as data contained in the CV to which we have access, i.e. professional data, work experience, educational background, age, gender, image (if included), personal characteristics that the candidate wished to highlight, special skills. - Linked to the previous purpose, the following one will include the processing of data throughout the selection process for which you have sent your CV, with the aim of having you as part of it. In this case, the legal basis for the processing is the need to process this data in order to be able to apply pre-contractual measures, in accordance with the provisions of article 6.1.b) RGPD. In relation to this purpose and in addition to the information indicated in the previous paragraph, Intecfy may have access to other information derived from the same, mainly based on the skills of the candidates, their personal and professional qualities and characteristics.
- Processing of data to suggest your application for other selection processes that we believe may be of interest to you. This processing of personal data is carried out on the basis of our legitimate interest, regulated in article 6.1.f) RGPD, so that we can obtain the maximum performance of our activity, given the specialization of the vacancies and therefore the candidates to whom our service is addressed. The personal data processed for this purpose will be the same as those indicated in the previous two paragraphs.
In addition, we will keep in the most absolute confidentiality any personal information to which we have access in the development of our activity, as well as we are obliged to comply with the maximum diligence the obligations to guarantee the security of the information to which we will have access, and thus maintain the confidentiality, availability and integrity of the same as much as possible.
Responsibility of candidates, recruiters, our clients and Intecfy
- Candidates commitments and responsibilities: In order for our activity to be as useful and beneficial to all parties involved in it, it is essential that candidates provide accurate, complete and truthful information throughout the recruitment process. Otherwise, our clients’ expectations of finding a profile that meets their needs and the performance of our activity would be seriously jeopardized. Therefore, candidates undertake to act at all times in good faith, and therefore shall be solely responsible for any direct or indirect damage they may cause to Intecfy and its clients, as a result of having provided inaccurate, incomplete and/or misleading information at the time of registration or throughout the selection process. Likewise, they shall be liable in case of failure to update this information, holding Intecfy and its clients harmless in this regard. In case Intecfy has suspicions that any information provided by a candidate may break the commitment indicated above, it reserves the right to exclude him/her from any recruitment process in which he/she is participating, and its database.
- Commitments and responsibilities of external recruiters and clients: The external recruiters and clients shall be solely responsible for the description of the offered position as well as, subsequently, being able to fill it and fulfil the guarantees and job expectations given to the selected candidate. The conclusion and execution of the relevant agreement with the selected candidate for each of the vacancies offered, is carried out at the initiative and under the sole responsibility of the latter. Likewise, clients undertake not to use the personal data to which they have access for purposes other than those for which they were communicated to them.
- Intecfy commitments and responsibilities: Intecfy offers a complete and personalized solution of IT Recruitment & Headhunting based in the connection, negotiation and recruitment of candidates. Thus, its function translates into putting professionals in contact with clients / recruiters interested in filling a specific vacancy in its entity with a profile that fits the same, being finally the decision of the client whether or not to hire the final candidate from among the profiles presented by Intecfy.
Among others, and by way of example and without limitation, Intecfy is not liable for the following circumstances:
- If candidates provide false, misleading, inaccurate, misleading or incomplete information when creating their profile and throughout the selection process. The candidates themselves shall be liable for any damages arising from such actions, exempting Intecfy from any liability related to the same. The information provided by the candidates throughout the registration and selection process, in case of discrepancies, candidates will be the only ones liable for it.
- From the lack of availability, commitment and/or compliance by the clients in formalizing the employment relationship, complying with the conditions offered and filling the vacancy in general for which the candidates have applied.
- Any action that is unlawful, negligent, fraudulent, contrary to the terms of these Terms and Conditions, or contrary to good faith on the part of external recruiters, clients and candidates.
Claims, applicable law and jurisdiction for the settlement of disputes
Any comments, notifications or complaints that candidates, external recruiters or clients would like to make in relation to these Terms and Conditions may be made by writing to info@intecfy.com.
These terms and conditions are originally drafted in Spanish and are subject to current Spanish legislation. Any type of dispute arising from the use of the services offered or the contents of the Website shall be subject to the jurisdiction and competence of the courts of the city of Madrid, if this is legally possible. Otherwise, they shall be submitted to the competent courts according to the legislation in force in each case.
